Step-by-Step Procedure
The LTB Litigation Lifecycle
Ontario tenancy litigation adheres to strict legal standards. Here is the structured path we follow to protect your legal and financial interests from start to finish.
Stage 01
Assessment & Pending Litigation Letters
We review your lease agreement, accounting ledgers, and correspondence history. If appropriate, we issue a formal Pending Litigation Letter to settle the matter without waiting months for a hearing.
Focus: Dispute appraisal, risk management, pre-action resolution.
Stage 02
Notices & Formal Applications
Procedural accuracy is paramount. We prepare statutory notices (N4, N5, N7, N12, T2, T6), calculate mandatory notice periods down to the exact day, serve via approved methods, and file Board applications (L1, L2, T1-T6).
Focus: Strict statutory compliance, certificate of service verification.
Stage 03
Evidentiary Audit & Portal Upload
Adjudicators dismiss unorganized submissions. We build indexed digital evidence briefs conforming to Tribunals Ontario Portal standards: banking ledgers, audio/video exhibits, municipal orders, and verified communication logs.
Focus: Rules of evidence, mandatory disclosure deadlines (Rule 19).
Stage 04
Dispute Resolution & Mediation
We engage in Board-led mediation or direct discussions with the opposing party. We draft bulletproof Standard Orders on Consent or mediated agreements that contain enforceable eviction or payment clauses if breached.
Focus: Risk mitigation, expedited resolutions, enforceable settlements.
Stage 05
Hearing Advocacy & Submissions
On hearing day, we represent you before the presiding LTB Member. We deliver opening arguments, conduct direct witness examinations, cross-examine the opposing party, and cite relevant binding case precedents.
Focus: Persuasive oral advocacy, case law applications, RTA statutory arguments.
Stage 06
Post-Order Relief & Enforcement
Obtaining an order is only half the battle. We assist with filing eviction orders with the local Sheriff (Court Enforcement Office), responding to Motions to Set Aside, filing Requests for Review, or garnishing arrears in Small Claims Court.
Focus: Sheriff writs of possession, small claims judgment conversions.
